On many weekends, Highway 400 carries heavy traffic between the GTA and cottage country, and Barrie sits along that route. If a trip north or a night out in Barrie ended with an impaired driving charge, your case will be heard at the Barrie Courthouse, whether you live in Allandale or in downtown Toronto. Charged in Barrie but live in the GTA?
Many of the people who call us about a Barrie charge do not live in Barrie. They were driving to or from a cottage, visiting family, or stopping in the city on the way back down Highway 400. Their first question is usually whether the case can be moved closer to home.
In general, it cannot. A criminal case is heard in the area where the charge was laid, and Barrie and area cases go to the Barrie Courthouse. What you can control is who represents you. Barrie Police Service or OPP: who charged you?
Two police services handle most impaired driving investigations in and around Barrie.
- Barrie Police Service. Responsible for stops within the city, from Downtown Barrie and Allandale to Painswick, Holly, Ardagh and Innis-Shore.
- OPP. Patrols Highway 400 and polices many of the surrounding townships, which is where a lot of cottage-country stops happen.
The agency matters because it controls the records. Officer notes, cruiser and booking video, and Intoxilyzer 8000C test records and maintenance logs all sit with the service that investigated you. We send our disclosure requests to the right place from the start, and missing or incomplete records can become part of the defence.
Highway 400 stops and the two-hour window
Highway 400 is the main route between Barrie and Toronto, and Highways 11 and 26 carry traffic further north and west. A stop on a highway usually begins with a driving observation, such as speed, weaving or a lane change, followed by a roadside screening test.
What often makes highway cases different is distance. If a driver is arrested on a rural stretch, getting to a station with an approved breath instrument can take time. The Criminal Code measures blood alcohol concentration within two hours after you stopped driving, so the timeline matters. We compare the time of the stop, the demand, the arrival at the station and each breath sample. Delays, gaps in the notes or unexplained waiting periods can all affect how the evidence is treated.
RIDE checks on cottage weekends and holidays
RIDE programs are common across Ontario, especially in the evening, on weekends and over the holiday season. Around Barrie, check stops can also appear on routes that carry heavy seasonal traffic, including long weekends when drivers are heading north or coming home.
At a RIDE stop, an officer with an approved screening device can demand a roadside breath sample from any driver who has been lawfully stopped, with no suspicion required. That rule, found in section 320.27(2) of the Criminal Code, came in with the 2018 amendments. It does not make every stop lawful, and the way the stop, the demand and the test were carried out can still be challenged. Drug-impaired driving charges in Simcoe County
Not every impaired driving charge involves alcohol. The Criminal Code sets blood drug limits measured within two hours of driving:
- THC of 5 ng/mL or more is the main offence.
- Alcohol of 50 mg plus THC of 2.5 ng/mL or more is also a full offence.
- THC between 2 and 5 ng/mL is a lesser offence, punishable by a fine of up to $1,000.
Police can also lay a charge based on a drug recognition evaluation or their own observations. Each method follows detailed procedures, and departures from them can weaken the case. Our page on drug-impaired driving defence goes into how these charges are tested.
Is it better to hire a Barrie DUI lawyer or a Toronto one?
The location of the office matters less than three practical questions. Does the lawyer regularly defend impaired driving cases? Will they read your disclosure closely? Will they appear in Barrie? What a conviction can mean
Impaired driving, over 80 and refusal are criminal offences. The consequences of a conviction build on each other:

For permanent residents and foreign nationals, a conviction can also have immigration consequences, and anyone who travels to the United States may face added questions at the border.
What to write down after a Barrie arrest
Memories of a stressful night fade within days. While the details are fresh, make private notes on:
- Where you had been, what you drank or took and when you finished.
- The time you started driving and the exact spot where you were stopped, including the highway exit or nearest intersection.
- What the officer said about why you were pulled over, and whether you were told about your right to a lawyer.
- How long you waited at the roadside, in the cruiser and at the station.
- Anyone who was with you and could describe the evening.
Share these notes only with your lawyer, since solicitor-client privilege protects what you tell us.

The Criminal Code applies the same way to both, but each service keeps its own notes, video and breath instrument records. Your paperwork names the agency, which tells us where to direct disclosure requests.
My licence is suspended. How do I get to court in Barrie?
This is a real concern for GTA drivers, because the 90-day licence suspension starts immediately and Barrie is a long trip without a car. For many routine appearances, a lawyer can attend on your behalf with your written authorization, so you may not need to travel. Some steps, such as a trial or a guilty plea, normally require you to be there, and we plan those dates with you.
Can I be charged if I was sleeping in my car at a cottage or trailhead lot near Barrie?
Possibly. The Criminal Code presumes that a person in the driver's seat is in care or control of the vehicle unless they prove they had no intention of setting it in motion.
