For many people in Markham, a car is not optional. It is how you get to work on Highway 404, drop the kids off in Cornell, or reach a job site across the 407. That is why a drinking and driving charge hits Markham residents so hard: the licence suspension starts immediately, long before any court decides anything. As a DUI lawyer Markham commuters can call at any hour, DUI Lawyer Toronto helps you deal with the suspension, understand the Newmarket court process and prepare a defence based on the evidence.
What a DUI charge means for Markham commuters
The first shock is usually the licence. If your breath test showed a reading over 80, if you were charged with refusing a demand, or if a drug evaluation found impairment, police will have imposed a 90-day Administrative Driver's Licence Suspension and a 7-day vehicle impoundment, along with an administrative monetary penalty. These take effect right away and are completely separate from the criminal charge.
For someone who drives to an office in Markham or commutes into Toronto, those 90 days can raise questions about employment, childcare and money. Ontario's reduced suspension program can sometimes get an eligible first offender back behind the wheel earlier, with an interlock installed. Qualifying is not automatic, the timelines are tight, and the program is tied to how the criminal case ends, so discuss it with a lawyer before you sign anything.
How impaired driving cases usually begin in Markham
Markham drivers are generally stopped in one of three ways.
- On the highways. The OPP patrols the 400-series highways, so stops on Highway 404 and the 407 are usually OPP investigations. Commuter traffic on these routes means stops often follow an observation about speed or lane changes.
- On Highway 7 and local roads. York Regional Police handle most stops elsewhere in the city, including on Highway 7 and in neighbourhoods such as Unionville, Markham Village and Berczy Village. Expect RIDE programs to be busiest after dark, on Friday and Saturday nights and in December.
- After a collision. A crash, even a minor one in a plaza lot, can lead to an impaired driving investigation if an officer suspects alcohol or drugs.
Markham's southern edge adds a local twist. Steeles Avenue forms the border with Toronto, and parts of Milliken sit right along it. A stop on the Toronto side is generally a Toronto Police Service matter heard at the Toronto courthouse, while one on the Markham side goes to Newmarket. If you were stopped south of the line, our page for drivers charged in Scarborough covers that process.
Choosing a DUI lawyer in Markham for a Newmarket case
Your case will be heard at the Newmarket Courthouse, where York Region criminal matters are prosecuted. For a Markham resident, that can mean a drive north on Highway 404 for each required appearance. A lawyer familiar with that courthouse can often handle routine dates on your behalf, so you are not taking a day off every few weeks.
The courthouse matters for strategy as well as convenience. How the local Crown approaches disclosure, early resolution and trial scheduling shapes the options available to you. Your lawyer should know how to press for complete disclosure, when to raise Charter issues, and how to keep the case within the 18-month ceiling set by R. v. Jordan for trials in the Ontario Court of Justice.
At the first appearance in Newmarket, nobody is asked to plead guilty or not guilty. The Crown starts handing over disclosure: the arresting officer's notes, the Intoxilyzer 8000C test records and maintenance logs, the breath technician's notes and any cruiser or station video. That package is the foundation of every decision that follows, and it deserves a careful read before you commit to any path.
First offence penalties at a glance
Many people charged in Markham have never set foot in a courtroom before. If that is you, this table sets out what the Criminal Code requires on a first conviction, before any defence is considered.
| Situation | Minimum fine | Driving prohibition |
|---|---|---|
| Blood alcohol 80 to 119 mg | $1,000 | 1 to 3 years |
| Blood alcohol 120 to 159 mg | $1,500 | 1 to 3 years |
| Blood alcohol 160 mg or more | $2,000 | 1 to 3 years |
| Refusing a breath demand | $2,000 | 1 to 3 years |
In addition to the court's order, Ontario imposes a one-year provincial licence suspension on a first conviction. A reading of 120 mg or more is also treated as an aggravating factor at sentencing. Our pages on a first offence DUI and on over 80 blood alcohol charges explain these penalties in more detail.
Licence, interlock and travel after a conviction
Getting back on the road after a conviction is a process. The province will not reinstate your licence until the Back on Track remedial program is done, and after that an ignition interlock becomes a licence condition for a minimum of one year. Our article on the Ontario ignition interlock program explains how the device and its conditions work.
Travel is another concern for Markham residents who cross the border for work, family or holidays. A DUI conviction is a criminal conviction, and it can complicate entry to the United States. Our article on DUI convictions and travelling to the USA covers the general picture. If you are a permanent resident or hold a work or study permit, be aware that immigration law classifies impaired driving as serious criminality, and speak with an immigration lawyer early.
Defences Markham clients ask about
Can the stop itself be challenged?
Yes, in some cases. Police need lawful authority to stop you, and s. 9 of the Charter protects against arbitrary detention. Random stops for sobriety checks are generally lawful, but what happens next still has to follow the rules.
What if I was not allowed to call a lawyer properly?
Section 10(b) of the Charter gives you the right to speak with a lawyer without delay. If police did not tell you about that right, rushed you, or did not give you privacy, a court may be asked to exclude the evidence under s. 24(2).
Can an impaired charge succeed without a breath reading?
It can. An impaired driving charge can rest on the officer's observations, such as driving pattern, speech and balance. Those observations can be tested against the video and against innocent explanations, like fatigue after a long commute.
Getting started from Markham
We do not have a Markham office, and there is no need to travel to see us. You can reach our Toronto team at 500 Yonge St, but a Markham file usually opens with a short phone or video call instead of an office visit. After that, we request disclosure, attend the Newmarket Courthouse for you, and explain what each step means for your licence and your case.
A good first call with a DUI lawyer Markham residents contact through our office is practical rather than overwhelming. We will ask about the stop, the testing and your release, and we will explain which dates are coming up and what the suspension means for your commute. Have your release papers, the suspension notice and any impound paperwork nearby, and jot down the timeline of the evening before we speak. Calls are confidential, and you are under no obligation to hire us.

Markham DUI lawyer FAQ
Where will my Markham impaired driving case be heard?
Markham is in York Region, so impaired driving charges laid in the city are heard at the Newmarket Courthouse. That applies whether you were stopped by York Regional Police on a local road or by the OPP on Highway 404 or the 407. Your release papers show the first appearance date. Counsel can usually stand in for you on that opening date, which spares you a weekday trip north.
I commute on Highway 404 every day. Can I keep driving after a DUI charge?
Usually not right away. Blowing over 80, refusing, or failing a drug evaluation means your licence is taken for 90 days and your car is impounded for a week, all before the criminal case even begins. A province-run program lets certain first offenders shorten the suspension by driving with an interlock, though it comes with firm deadlines and consequences for your defence, so get advice before choosing it.
What is the minimum fine for a first DUI conviction in Markham?
The minimums come from the Criminal Code and apply across Canada. A first offence starts at $1,000. The floor climbs to $1,500 when the reading is between 120 and 159 mg, and to $2,000 once it reaches 160 mg. Refusing a breath demand carries a minimum $2,000 fine. A conviction also brings a driving prohibition and a provincial licence suspension.
Will a DUI conviction affect my travel to the United States?
It can. A DUI conviction is a criminal conviction, and it can complicate entry to the United States because border officers have discretion over who is admitted. The effect varies from person to person. If you cross the border regularly for work or family, tell your lawyer early so travel concerns can be considered when weighing how to approach the case.
I was stopped near Steeles Avenue in the Milliken area. Which court handles my case?
It depends on exactly where the stop happened. Steeles Avenue marks the boundary between Toronto and York Region, and cases are generally heard in the courthouse for the area where the offence took place. A stop on the Markham side would usually go to Newmarket, while a stop on the Toronto side would usually go to the Toronto courthouse. Your paperwork will confirm it.
